Well, not when they're playing with real guns...
As much as I dislike my son playing with toy guns or toy lasers or other toy weapons, I have come to acknowledge that many boys are simply wired for battle attitudes. Some will turn teddy bears into machine guns in their imaginations.
However, I truly think that most kids (well, non-bullet-toting kids) view toy gun play not as the vicious thing it mimics, but as pure adventure. Personally, I think the red flag warning has less to do with Playing With Toy Guns, and more to do with the attitudes and behaviors the child exhibits when playing with toy guns. Pointing toy gun at imaginary bad-guy robots: okay; pointing toy gun at household pet or sibling: not okay.
And yes, playing with real guns and live ammunition does qualify as one of those red flags.

UPDATE:
The story now is that this was not an accident. The boy brought the gun to day care in order to rob the girl. In the process of robbery, he shot her. He is now charged with multiple crimes.
He got the gun from his 56 year old father, who has multiple weapons at home. As a convicted felon, the father is now charged with a number of crimes, too, including possession of a gun as a felon.
The girl is stable in a Washington DC hospital.
